RE: The tariff classification of a lighted decorative glass egg from China.

Dear Ms. Portillo:

In your letter dated October 15, 2014, you requested a tariff classification ruling.

The merchandise under consideration is described as the Hand Blown Glass Egg. A sample was submitted with your ruling request and was forwarded to the Customs and Border Protection Laboratory for analysis. This analysis has been completed.

The Hand Blown Glass Egg is made of glass and measures approximately 7.25 inches high. It is egg-shaped, but the wide end provides a flat bottom so that the egg can stand upright. It is yellow in color, with a red spiral design running from the narrow to the wide end of the egg. On the bottom of the egg is a compartment for three AAA batteries and an on-off slide switch. When activated, an LED light within the egg illuminates, enhancing its decorative effect.

Laboratory analysis has determined that the sample contains glass thread-like and ribbon-like effects. It was colored prior to solidification, but it does not contain bubbles, seeds, or stones. It does, however, contain arsenic oxide as a fining agent.

The applicable subheading for the Hand Blown Glass Egg will be 7013.99.1000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Glassware of a kind used for table, kitchen, toilet, office, indoor decoration or other purposes…: Other glassware: Other: Glassware decorated with…glass thread- or ribbon-like effects, any of the foregoing introduced into the body of the glassware prior to its solidification.” The general rate of duty will be 15 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
